Terms of Service

1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the EveryLastMile mobile application and related services (collectively, the “Services”). By downloading, installing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, and “you” refers to that entity.
2. Eligibility
You must be at least 13 years old to use the Services (or 16 in jurisdictions where a higher minimum age of digital consent applies). If you are under the age of majority in your jurisdiction (typically 18), a parent or legal guardian must review and agree to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
3. Description of the Services
EveryLastMile is a privacy-first mileage tracking application for iOS that helps you:
- Record drives manually (tap to start/stop) or automatically (background detection using GPS and motion sensors)
- Classify drives as business, personal, medical, charitable, or moving
- Add trip details including business purpose, notes, parking and toll expenses, and vehicle assignment
- Review mileage logs with distance, duration, route, and start/end addresses
- Generate IRS-compliant mileage reports (Premium feature) exportable as PDF
- Export your data in JSON or CSV format
- Sync across devices via your personal iCloud account (optional)
3.1 Accuracy Disclaimer
Trip detection, distance calculation, GPS coordinates, and reverse-geocoded addresses are provided on a best-effort basis using your device’s sensors and Apple’s location services. They are not guaranteed to be perfectly accurate. Factors including GPS signal quality, device hardware, environmental conditions, and software limitations may affect results. You are solely responsible for reviewing, confirming, and correcting your mileage records before using them for any tax, reimbursement, or legal purpose.
3.2 IRS Mileage Rate Calculations
The app calculates estimated tax deductions using standard IRS mileage rates published by the Internal Revenue Service. These rates are updated periodically within the app but may not reflect the most current rates at all times. Deduction estimates are provided for informational convenience only and do not constitute tax advice.
4. No Tax, Legal, or Accounting Advice
The Services provide tools and information for recordkeeping convenience only. We do not provide tax, legal, or accounting advice. You are solely responsible for:
- Compliance with applicable federal, state, and local tax laws
- Accuracy of mileage deductions claimed on your tax returns
- Meeting IRS documentation requirements (IRS Publication 463)
- Compliance with employer reimbursement policies
- Consulting with a qualified tax professional regarding your specific situation
EveryLastMile is not a registered tax preparer, CPA firm, or law firm. No information provided through the Services should be construed as professional advice.
5. Accounts and Security
5.1 Account Creation
You may create an account using Apple Sign In. When you do, Apple provides us with your name and email address (or a private relay email, at your option). Your authentication credentials are managed by Apple and Firebase Authentication; we do not store passwords.
5.2 Your Responsibilities
You are responsible for:
- Maintaining the security of your Apple ID and device
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access
- Keeping your device passcode secure (your trip data is protected by iOS device encryption)
5.3 Account Sharing
Accounts are for individual use. You may not share, sell, or transfer your account credentials to another person. Each user should maintain their own account.
6. Permissions, Device Features, and Safety
6.1 Required Permissions
The Services rely on device permissions to function. The following permissions are requested:

You can change these permissions at any time in your iOS Settings. Disabling permissions may degrade or disable certain features as described above.
6.2 Background Location Use
When you enable automatic trip detection (“Always Allow” location), the app monitors for driving activity in the background using a combination of GPS location updates, motion sensors, and iOS visit monitoring. Background location data is processed entirely on your device and is never streamed to a remote server. You can disable background location access at any time.
6.3 Safety Warning
Do not interact with the app while driving or operating machinery. The Services are designed to work automatically in the background or to be operated while your vehicle is stationary. You are responsible for complying with all applicable traffic and safety laws.
7. Subscription Plans, Billing, and Cancellation
7.1 Free and Premium Tiers

The free tier limit of 30 autotracked drives resets at the beginning of each calendar month. Drives already recorded are not affected when you reach the limit; only new automatic detections are paused until the next month.
7.2 Subscription Options
Premium is available as:
- Monthly subscription, billed monthly
- Annual subscription, billed annually (at a discounted rate)
Pricing is displayed in the app at the time of purchase and may vary by region.
7.3 Billing and Platform Terms
All purchases are processed through Apple In-App Purchase and are subject to Apple’s terms and conditions. We do not directly process payments or store payment information (credit card numbers, billing addresses, etc.).
- Auto-renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
- Billing: Your Apple ID account is charged upon purchase confirmation and upon each renewal
- Plan changes: You may switch between monthly and annual plans; changes take effect at the next renewal date
- Price changes: If we change subscription pricing, Apple will notify you and require opt-in for the new price
- Manage or cancel: Settings > [your name] > Subscriptions on your iOS device, or at apps.apple.com/account/subscriptions
7.4 Refunds
Refund requests are handled by Apple according to Apple’s refund policy. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.
7.5 Free Trials and Introductory Offers
We may offer free trials or introductory pricing from time to time. Trial terms will be displayed at signup. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.
8. Acceptable Use
You agree not to, and not to assist or encourage others to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except to the extent expressly permitted by applicable law
- Access or interact with the Services using automated means (bots, scrapers, crawlers), or bypass any access controls, rate limits, or security measures
- Interfere with, disrupt, or place an unreasonable burden on the Services, servers, or networks
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Use the Services to infringe upon the intellectual property rights or privacy of others
- Upload malware, viruses, or other harmful code
- Attempt to gain unauthorized access to any part of the Services or related systems
- Falsify or manipulate mileage records with intent to defraud a tax authority, employer, insurer, or any other party
- Create multiple accounts to circumvent the free tier limits
- Share, resell, or sublicense your access to Premium features
9. Your Content, Trip Data, and License
9.1 Ownership
“User Content” includes trip data, route recordings, classifications, notes, business purposes, expense entries, vehicle information, saved locations, and any other data you create or provide through the Services. You retain full ownership of your User Content.
9.2 License to Us
You grant us a limited, non-exclusive, royalty-free license to process your User Content solely as necessary to:
- Provide, maintain, and improve the Services (including on-device processing, iCloud sync, and report generation)
- Comply with applicable law
This license terminates when you delete your data or account.
9.3 Data Portability
You may export your User Content at any time via Settings > Export Data. Exports are available in JSON and CSV formats and are generated entirely on your device.
9.4 Feedback
If you submit feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback for any purpose without compensation or attribution. Do not submit feedback that you consider confidential.
10. Intellectual Property
The Services, including the software, user interface designs, graphics, icons, trademarks, trade names, and documentation, are owned by EveryLastMile or our licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services on your personal iOS devices in accordance with these Terms. This license does not include the right to:
- Modify, adapt, or create derivative works of the Services
- Use EveryLastMile trademarks without prior written permission
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
11. Third-Party Services
The Services integrate with or rely upon the following third-party services:

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. If a third-party service becomes unavailable, features that depend on it may be degraded or unavailable.
12. Suspension and Termination
12.1 By Us
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe that you:
- Violated these Terms or our Privacy Policy
- Engaged in fraudulent, abusive, or illegal activity
- Posed a security risk to the Services or other users
Where practicable, we will provide notice and an opportunity to cure before termination, except where immediate action is necessary to protect the Services or comply with law.
12.2 By You
You may stop using the Services at any time by:
- Deleting the app from your device
- Deleting your account via Settings > Delete Account (this permanently removes all your data)
- Cancelling your subscription via Apple’s subscription management
12.3 Effect of Termination
Upon termination:
- Your license to use the Services ends immediately
- We recommend exporting your data before deleting your account, as deletion is irreversible
- Active subscriptions must be cancelled separately through Apple (account deletion does not automatically stop billing)
- Sections 4, 9.4, 10, 13, 14, 15, 16, and 17 survive termination
13. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY, the Services may not meet your commercial expectations
- FITNESS FOR A PARTICULAR PURPOSE, including but not limited to IRS compliance, tax preparation, or any specific recordkeeping requirement
- NON-INFRINGEMENT, we do not warrant that the Services do not infringe third-party rights
- ACCURACY, trip distances, GPS coordinates, addresses, deduction calculations, and IRS mileage rates may contain errors
- AVAILABILITY, the Services may be interrupted, delayed, or contain errors
- DATA INTEGRITY, while we employ reasonable safeguards, we do not guarantee against data loss or corruption
You acknowledge that mileage records generated by the Services are estimates based on GPS data and should be independently verified before use in tax filings, reimbursement claims, or legal proceedings.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Without limiting the foregoing, we are not liable for:
- Inaccurate mileage records, trip distances, or deduction calculations
- Tax penalties, audit assessments, or denied deductions resulting from reliance on the Services
- Loss of trip data due to device failure, software bugs, or user error
- Failure of automatic trip detection to capture a drive
- Actions taken by Apple, Google, or other third-party service providers
Our total aggregate liability for all claims arising out of or related to the Services shall not exceed the greater of: (a) the amount you actually paid us for the Services in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless EveryLastMile and our officers, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Services
- Your User Content
- Your violation of these Terms or applicable law
- Your reliance on mileage records or deduction calculations for tax, legal, or reimbursement purposes
- Any dispute between you and a third party (including the IRS, an employer, or an insurer) relating to data generated by the Services
16. Dispute Resolution, Arbitration, and Class-Action Waiver
IMPORTANT: This section affects your legal rights. Please read it carefully.
16.1 Informal Resolution First
Before initiating any formal dispute resolution, you agree to contact us at legal@everylastmile.app with a written description of your dispute. We will attempt in good faith to resolve the dispute informally within thirty (30) days. Most concerns can be resolved quickly this way.
16.2 Binding Arbitration
If we cannot resolve the dispute informally, you and EveryLastMile agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified by these Terms.
- Location: Arbitration shall take place in Los Angeles County, California, unless you and we agree otherwise or the AAA rules require a different location
- Virtual option: Either party may request that the arbitration be conducted by telephone, video conference, or based on written submissions
- Fees: If your claim is for USD $10,000 or less, we will pay all AAA filing, administration, and arbitrator fees. For claims above $10,000, fees are governed by AAA rules
- Binding decision: The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction
Exceptions to arbitration: Either party may bring a claim in small claims court (if the claim qualifies) or seek injunctive relief in court for intellectual property infringement or misuse.
16.3 Class-Action Waiver
YOU AND EVERYLASTMILE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. Neither party may participate in a class action, class arbitration, collective action, or representative action.
If a court or arbitrator determines that this class-action waiver is unenforceable as to a particular claim, then that claim (and only that claim) shall be severed and proceed in court.
16.4 Thirty-Day Right to Opt Out
You may opt out of the arbitration agreement and class-action waiver by sending written notice to legal@everylastmile.app within thirty (30) days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out. If you opt out, our remaining Terms still apply.
16.5 Time Limit on Claims
Any claim arising out of or related to these Terms or the Services must be filed within one (1) year after the claim arises. Claims filed after this period are permanently barred.
17. Governing Law
These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-laws provisions. To the extent that litigation is permitted (e.g., claims not subject to arbitration), the exclusive venue shall be the state and federal courts located in Los Angeles County, California.
18. Apple App Store Additional Terms
If you downloaded the Services from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and EveryLastMile only, not Apple Inc. (“Apple”)
- Apple has no obligation to furnish any maintenance or support services with respect to the Services
- In the event of any failure of the Services to conform to any applicable warranty (if any), you may notify Apple and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Services
- Apple is not responsible for addressing any claims by you or a third party relating to the Services or your possession and use of the Services, including but not limited to: (a) product liability claims; (b) any claim that the Services fail to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation
- In the event of any third-party claim that the Services or your possession and use of the Services infringes that third party’s intellectual property rights, EveryLastMile (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties
- You must comply with applicable third-party terms of agreement when using the Services (e.g., your wireless data agreement)
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy and any subscription terms presented at purchase, constitute the entire agreement between you and EveryLastMile regarding the Services and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall be effective only if in writing and signed by EveryLastMile.
19.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
19.5 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or infrastructure failures, or Apple platform outages.
19.6 Notices
We may provide notices to you through the app (in-app notifications or banners), via the email associated with your account, or by other reasonable means. Notices to us must be sent to legal@everylastmile.app.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through an in-app notification or other reasonable means at least fourteen (14) days before the changes take effect. The “Effective Date” at the top indicates the most recent revision. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.
